Welcome to our Terms and Conditions page. Here, you will find information on our policies regarding your privacy, refunds, and damage to our vehicles. We strive to provide clear and concise policies to ensure a positive experience for all of our customers.

Our Service

These are the terms and conditions for B W Taxi Service in New Zealand.

The terms outline the use of the services provided by the company in accordance with the laws of New Zealand. By accessing or using the services, you agree to comply with and be bound by these terms. 

B W Taxi Service provides  a transportation services, connecting users with a driver that will take them to their designation. Users must be of legal age to use the services and are responsible for providing accurate and complete information for booking. Payments for the services can be made through the methods specified on this website.

Charges

All charges are displayed before confirmation, and users agree to pay the specified amount for the services received.

Current charges are $4 per kilometer, with a minimum charge of $10 for each ride.

Animals

We do allow for Animals in Cages or Controlled Dogs. Passengers may bring friendly, controlled dogs, or animals in cages during the ride. It is the passenger’s responsibility to ensure the safety and proper restraint of the animals.

We are also willing to transport caged animals from point a to point b for the taxi rate. For this service the animal must be contained within an approved transport cage. The person booking this service must provide a collection person at the other end and must provide the transport cage

Drivers have the right to refuse service if they deem the animal poses a safety risk or is not properly restrained.

The owner of the animal is fully responsible for any damage caused by the animal during the ride.

Assistance for Incapacitated  Passengers.

If a passenger is visibly intoxicated, they must be accompanied by a sober person who will ensure the passenger’s safety during the ride. The sober person is responsible for assisting the intoxicated passenger during the ride.

Drivers have the right to refuse service to visibly intoxicated passengers if they do not have a sober person accompanying them.

The Driver, at their discretion, may return the sober person back to the point of origin (e.g., the party location) after ensuring the safe arrival of the intoxicated passenger.

A fee may be charged to the sober rider for the return trip, and the amount will be communicated by the Driver.

The sober person is responsible for ensuring the safe arrival of the intoxicated passenger at their destination.

Cancellations and Refunds

A passenger can cancel a booking up to 1 hour before the scheduled pickup time without incurring any charges. Cancellations made within 1 hour of the scheduled pickup time may be subject to a cancellation fee of 15% their booked fare.

In the event of a service disruption or failure to meet the agreed upon service standards, users may be eligible for a refund.

Refunds will be processed in accordance with our refund policy,

 

 Refund Policy:

Refund requests must be submitted in writing within 48 hours of the  of the service in question.

Refunds will be considered based on the circumstances surrounding the service disruption or failure to meet service standards.

Complainant will be notified of the outcome of an investigation of the complaint within 7 days of the complaint being received.

Refunds, if approved, will be processed within 5 working days of the approval date and will be credited to the original payment method used for the booking.

Refunds will not be issued for cancellations made within 1 hour of the scheduled pickup time unless there is a documented service issue.

5-Minute Wait Time:

Passengers are entitled to a 5-minute waiting period from the scheduled pickup time unless the rider has made contact. During this time, the Driver will wait for the passenger to arrive.

If the passenger does not appear within the 5-minute waiting period, the Driver may cancel the ride, and the cancellation policy may apply.

Driver and Passenger Conduct

Passenger Conduct:

Passengers are expected to behave respectfully and responsibly during the use of our services.

Any form of harassment, discrimination, or abusive behavior towards Drivers or other users is strictly prohibited.

 Abusive behavior will not be tolerated, and riders engaging in such behavior may be excluded from any future services provided by B W Taxi Service.

 Driver and Passenger Safety:

Both the Driver and the passenger are responsible for their safety during the ride. Any behavior that compromises safety or violates local laws is strictly prohibited. All passengers must wear safety restraints unless they are able to provide medical documentation preventing this.

Changes to Destination or Stops:

It is up to the Driver’s discretion to accommodate changes to the destination or additional stops during the ride.

The Driver has the right to refuse changes to the destination or stops, including requests for stops at locations such as McDonald’s.

Lost Items :

If any items are found in the car, all attempts will be made to return them to the owner.

If no owner is found after 14 days, the items will become the property of  B W Taxi Service.

Wait Charge for Stops:

 A wait charge may apply to the ride if additional stops are requested, such as a stop at a supermarket.

The wait charge is $5 per 10 minutes or part thereof during the additional stop.

 Liability:

B W Taxi Service is not liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of our services, to the extent permitted by New Zealand law.

Passengers are responsible for their personal belongings during the ride. B W Taxi Service is not responsible for lost, damaged, or stolen items. Any Items left in the Taxi will be returned to the office and all possible steps will be taken to return these to the rightful passenger.

Privacy:

The collection and use of personal information are governed by our Privacy Policy .By using our services, users consent to the collection and use of their personal information as outlined in our Privacy Policy, in compliance with New Zealand privacy laws.

 Changes to Terms:

B W Taxi  Service reserves the right to modify or update these Terms at any time. Passengers will be notified of changes, and continued use of our services constitutes acceptance of the modified Terms.

 Governing Law:

These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising under or in connection with these Terms shall be resolved in the appropriate courts of New Zealand.

Dashcam Usage:

 For the safety and security of both passengers and drivers, a dashcam will be in use at all times during the ride. The dashcam footage may be used for purposes such as verifying incidents, resolving disputes, and ensuring compliance with company policies. By using our services, passengers consent to the recording of audio and video footage during the ride.

No dashcam footage will be provided to the general public without Police request.

No Smoking, Vaping, Food, or Drink:

Valued passengers, we would like to kindly remind you that smoking, vaping, and consumption of food and drinks are strictly prohibited inside the vehicle during the ride. This policy has been put in place to ensure a clean comfortable environment for all passengers and drivers, while also adhering to the current legal requirements regarding any minors in the vehicle. We kindly request your cooperation in adhering to this policy, as violation may result in additional cleaning fees and penalties. Thank you for your understanding and support in maintaining a safe and pleasant ride for all

Call Recording:

For quality assurance, Safety and training purposes, all calls made to B W Taxis may be recorded. By engaging in a call with B W Taxi Service, you consent to the recording of the conversation. Recorded calls may be used for internal review, training, or resolving disputes.

 

By using the services provided by B W Taxi Service, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in compliance with the laws of New Zealand. If you do not agree with any part of these Terms we understand and appreciate your time. You are welcome to utilize another taxi service

Extra Charges

Wait Charge for Stops:

 A wait charge may apply to the ride if additional stops are requested, such as a stop at a supermarket.

The wait charge is $5 per 10 minutes or part thereof during the additional stop.

Soilage Fee:
A soilage fee upto $250 may be applied to any ride if the rider creates a mess in the taxi, necessitating additional cleaning and sanitization. This includes incidents such as spills, stains, or dirt caused by dirty shoes, in addition to other forms of soilage.

Prepayment for Rides over $100:

Rides with a total fare exceeding $100 will require prepayment, unless the passenger is a known customer with a history of timely payments. Prepayment must be made through the methods specified on our platform prior to the commencement of the ride. Failure to prepay may result in the cancellation of the booking.

 Limitation of Claims:

Any claims against BW Taxi Service, its affiliates, employees, or agents, in any way related to the services provided, shall be limited to a maximum of $200. This limitation applies to all claims, including but not limited to damages, losses, injuries, or disputes arising from the use of our services.
